Presidenta da CIDH critica redução da maioridade penal no Brasil
A presidente da Comissão Interamericana de Direitos Humanos (CIDH), Margarette Macaulay, afirmou nesta segunda-feira que crianças “de zero a 18 anos não devem ser presas” e que a redução da maioridade penal no Brasil seria “infeliz”.
Após uma reunião com o presidente do Supremo Tribunal Federal (STF), Dias Toffoli, em Brasília, Macaulay disse que, segundo as normas vigentes no direito internacional, qualquer pessoa com menos de 18 anos não pode ser considerada adulta.
“A Comissão Interamericana dos Direitos Humanos segue o padrão internacional de respeito à infância. Crianças, como definido, de zero a 18 anos, não devem ser presas, a menos que sejam circunstâncias extremas”, declarou Macauley a jornalistas depois do encontro com Toffoli.
Perguntada se, segundo sua opinião, a redução da maioridade penal seria um “retrocesso”, a presidente da CIDH respondeu que “definitivamente”.
“Seria muito infeliz, pois afetará os direitos das crianças, de pessoas que são consideradas crianças de acordo com o direito internacional. E o Brasil assinou a convenção a respeito dos direitos das crianças”, destacou Macauley.
A redução da maioridade penal, dos atuais 18 anos para os 16, é uma das principais propostas do presidente eleito, Jair Bolsonaro, cujo mandato começará em janeiro.
No entanto, Macauley evitou comentar assuntos relacionados à política local e considerou que ainda não é possível fazer avaliações sobre o futuro governo de Bolsonaro.
A presidente da CIDH assegurou também que a reunião com Dias Toffoli foi “proveitosa”, embora tenha destacado a avaliação negativa que o Brasil obteve com relação ao respeito dos direitos humanos no país.
Macauley pontuou que, no último relatório elaborado pela CIDH, o Brasil recebeu uma nota que se refere a “uma posição baixa com relação à realização dos direitos humanos” e, por isso, o organismo multilateral vinculado à Organização dos Estados Americanos (OEA) organizou esta “visita in loco”.
“Os dados e as informações compartilhadas pelo magistrado Dias Toffoli serão um grande auxilio no relatório detalhado que iremos escrever sobre o estado atual do Brasil”, ressaltou Macauley.
Por sua parte, Toffoli explicou que a reunião com a presidente da CIDH se centrou, sobretudo, no acesso à Justiça e na recente decisão do Supremo que concedeu prisão domiciliar a mulheres grávidas ou com filhos menores de 12 anos que estavam presas.
A delegação da CIDH liderada por Macauley iniciou nesta segunda-feira uma visita ao país para avaliar a situação em matéria de direitos humanos e que se estenderá até o próximo dia 12.
Os integrantes da comitiva visitarão oito estados do país, além de Brasília, e terão reuniões com diferentes autoridades, com representantes da sociedade civil organizada e com militantes das organizações de defesa dos direitos humanos.
Também estão previstas visitas a unidades carcerárias do país, pois, segundo Macauley, a CIDH, em geral, “está bastante insatisfeita” com a situação carcerária do Brasil.
